Bplay in trouble with RIM?

So Jlevy73 ran across this interesting article regarding Bplay and their release of the Tour themes, before the actual Plazmic update came out. It seems RIM has confirmed that Bplay tampered with the with the Content Developers Kit and is investigating the matter. If you look at the license agreement for plazmic you will notice the following paragraph:

You agree that except to the extent that Plazmic is expressly precluded by law from prohibiting You from doing so, You will not alter, modify, adapt, create derivative works, translate, deface, decompile, disassemble or Reverse Engineer the CDK, or attempt to do so, or permit, acquiesce, authorize or encourage any other person to do the same.

So I am interested in what comes of this down the road since it has been rumored that RIM owns some stake in Bplay. What does everyone think?

The fact they tampered with it is one thing but they were selling the end product for profit. I'm sure that's what got RIM bent out of shape

I had a feeling something fishy was going on with that. I don't think its coincidence that Plazmic updated just days after that either. I think they wanted to squash that.

IMO I believe that RIM did give them the updated CDK. They got caught and are now trying to backpeddle. Nothing will come of this because I believe that they do have a vested interest in bplay.
