Since January, the battle
between BlackBerry, and iPhone QWERTY keyboard maker, Typo Products LLC, has been going back and forth. In the most recent development as reported via Bloomberg
, it looks as though the case will soon be ruled upon by Judge William H. Orrick. "If the consumer can look at this and say this product is ripping off BlackBerry and knows it's not a BlackBerry product, how does that make a difference in my analysis?" Orrick said at the hearing. Orrick also said that he will issue a ruling on BlackBerry’s request to block Typo sales “promptly.”
BlackBerry takes the stance that Typo's keyboard was an "intentional and deliberate" copy of their latest BlackBerry keyboard design for the BlackBerry Q10 device. Kevin Johnson, BlackBerry's lawyer for the case, said, "The similarities between Typo’s iPhone case, which has a keypad that attaches to the iPhone 5 and iPhone 5s to allow users to easily tap out messages, and the keyboard for BlackBerry’s Q10 smartphone are unmistakable."
