Thread: Real legal issue with BBM 5

i spoke with a mutual friend of mine who works in rims legal dept. rim is mad in many different ways. heres what i got from him.

"the bbm 5.0 and several storm 5.0 os leaks as well as many other leaks fell through the cracks from rim employees as well as testers, programmers, even carrier employee field testers. now the problem is all where under nda. which in basic is a contract that the person who had the software distributed by rim is property of rim. and is not to be released. sold. or distributed. in any way shape or form" word for word from the horses mouth.

the problem this caused which is well known to us. or maybe not but also from the horse mouth. (lawyer) "the release of bbm 5.0 which was downloaded by upward of 1 million people. as of thursday morning. apparently bbm5 uses 2x the bandwidth of the current bbm. causing rims servers to seize and over load. causing messaging to go out and sit between the user and the server(which caused the send receive delays) and as they got servers back up messages would then all go out at once or in different order. the server problems caused the big wigs to step in and get to the bottom of where the leaks came from. also getting them to see the power of the servers they need for the full roll out of bbm5.0 in the near future"

also went off the record of saying rim is not going after "bloggers" there going directly after the people who specifically signed nda or as i like to call em gag orders. not users or distributors of bbm 5.0 who are not legally binded on paper to rim. all they can do is "request links be taken down" or forcefully take links down" no legal trouble from what im hearing unless someone physically signed a contract with rim....

Are still going to play it safe, especially after the emails
That were sent out. There are ways around the hybrid issues
It would just be more complicated than the usual download and run.
Its nice to here there mad at the right people though.

Oh we got the legal notice from RIMs lawyers to remove the files. Whoops. Really didn't think it would cause RIMs servers to shut down by me leaking it...

I'm sure you can advise them on how to upgrade to a larger server.

We all have a relationship with RIM and as much as we love leaks, we don't want to cause trouble for them either.

Imagine how many emails they must have gotten from all people that didn't know how to remove Quincy.

And bbm5 crashed their servers. At least they will know to upgrade their servers before releasing official bbm.

At least RIM got a stress test of BBM 5.0 servers and knows they need A LOT more server bandwidth for the "official" release which is something they wouldn't have known until way later and it could have been a lot worse.

Still it is good to know that RIM isn't going to tie up their legal teams with going after individual users or web/blogger sites but going after those who broke the legal contracts they signed. I know I am just like every other true BB enthusiast who literally likes to be on the edge of the BBOS, but I still have to wonder what is the potential damage to RIM?

The BBM Server outage could have had negative impact on RIM's stock, which in turn will only push RIM to further hunt down the leaks and potentially provide different companies or individuals with OS codes that have tracking built in or codes assigned that are internal use only. I would hate to see the loss of the bleeding updates that we see, but I would not want to loose my BlackBerry either.

i never understand why they so upset about it. i mean it's better leak so they can know what are the problems

as much stuff that gets leaked ...they (rim) should have known that there could be a high possibility that bbm5 could leak so they should have been aware that some thing like their servers not being able to handle all that info at once.
and yes I don't want rim to have any problems with there servers cause that will create problems for all

what i really dont get is how bbm 5 uses "double the bandwidth" of reg bbm. other then the app being larger 1.1mb as oppose to 430kb.. other then new features its not like the messages are sent and received any different or am i mistaken.? my original quote was from a friend who happens to work in legal dept in rim. personally i dont think he knows the first thing about bandwidth or data usage. but knows the laws. anyone here fill me in on how the new bbm could use 2x the bandwidth as the old? im curious myself
