    Blackberry could be banned in the USA

    Research In Motion was hit yesterday with yet another patent infringement case filed with the International Trade Commission (ITC) in Washington. The new case was filed by Prism Technologies LLC, a company based in Omaha, Nebraska. Prism is claiming that the BlackBerry devices, desktop software, and servers infringe a patent for an authentication system that can be used with services conducted over the Internet.

    Prism may be trying to force RIM into settling the dispute. The ITC has the power of a “nuclear bomb” in a patent dispute because the agency can order U.S. customs officials to prevent goods from entering the country, said Lyle Vander Schaaf, a patent lawyer with Bryan Cave in Washington who specializes in ITC cases, but isn’t involved in this one.


    “It’s not really the damages that force you to settle; it’s the threat” of an import ban, Vander Schaaf said in an interview with Bloomberg. “We’re seeing more cases filed by companies who are frustrated with how things are going in district court or frustrated with the other party.”

    The ITC also has the power to halt sales of already imported BlackBerry devices. The ITC has, in the past, ruled that a transmission signal from another country is consider an import, thus meaning RIM would have to stop sending electronic signals to your BlackBerry's.

    Apparently, the ITC is quicker in their probes (only about 15months), compared to civil suits that can take years to settle. If the ITC finds Prism to be the victor in this case, those in the U.S. may no longer be able to use BlackBerry's! I wonder if President Obama could change this? Haha, he might be just as upset as the rest of us! What would you do if you couldn't ever use a BlackBerry again?

    wow that sucks...i would take a gander at trade agreements and trade zone guidelines...I mean yes, okay they messed up, but by the ITC 'forcing' an established brand out of the US wouldn't that be in some way illegal? I mean, you can't block off business in a 'capitalist' country (unless you are Hugo Chavez and some others i wont begin to name) because you are mad?

    regardless of the outcome, there will be a lot of mad people in the US

    OMG!..That's enormous..What would the "government" employees do? Considering there are Millions if not Billions of corporate bb users out there and not to mention the same numbers for personal bb users...This should have made "Breaking news" on the major networks..I personally have no clue what i would do..Maybe go back to Droid..Who knows..

    We are so mother fucking lucky that President Obama loves blackberry's as much as we do!

    He even had his own custom build blckberry meaning if it gets banned his will have to go aswell... Which I dont think not for one second that blackberry's will ever be banned in the United States Of America the Land of the FREE! Fuck those lawsuites!

    I really doubt this will happen. This was tried a few years back and it was settled. There are just too many government users using BB's to shut them down.

    Yet another twist on the rumor that all bullets would have a traceable mark on them... This same line of storytelling has been (officially) running through the rumor mill since the '40s.
    If, and only IF they were to succeed, this would be a property rights struggle that could destroy their company through Constitutional infringements.
    Look at what happened to the country when alcohol was banned...

    This will not happen, there is too much revenue being generated by US users that RIM will settle this frivolous lawsuit. This is just a ploy to generate media coverage and make money. Lawsuits for things like this IMO are ridiculous. If indeed this is the case why is it being brought forward now?

    No way this would happen. If you've ever been close to the political circles in DC, the first thing you will learn is that our government runs off Blackberry. Just about every congressman, senator and aide carries one. It's as standard as wearing a tie. Blackberry is "too big to fail" in the government's eyes.

    I agree 100%
    This company is just looking for some money, thats why it took them almost 10yr to file a patient law suite after RIM. Blackberries are doing better than ever because RIM went after the non corporate market and made a killing.
